Privacyverklaring

Het is mogelijk dat Triskal (de beheerder van deze site) bij het aanbieden van diensten informatie van jou als Triskal-gebruiker verwerkt (deze informatie wordt hieronder aangeduid als ‘persoonsgegevens’). We gaan zorgvuldig met de aan ons doorgegeven informatie en persoonsgegevens om. Hiervoor hebben we de volgende regels opgesteld waaraan wij ons als bedrijf houden. Ook bezoekers van onze websites mogen ons te allen tijde aan deze regels houden.

Het is mogelijk dat het aantal websites dat onder Triskal valt in de toekomst wordt uitgebreid. Eventuele wijzigingen zijn op deze pagina terug te vinden. Triskal adviseert u dan ook regelmatig op deze pagina te kijken of er veranderingen zijn doorgevoerd.

Triskal houdt zich aan de geldende Nederlandse Wet Bescherming Persoonsgegevens (WBP), de Europese richtlijnen en de gedragcodes van de Dutch Dialogue Marketing Association (DDMA). Meer informatie over de DDMA is te vinden op http://www.ddma.nl.

Het verstrekken van persoonsgegevens is niet verplicht

Uitgangspunt van Triskal is dat het verstrekken van persoonsgegevens aan Triskal of haar partners nooit verplicht is. Je hebt altijd zelf de keuze of je je gegevens wilt invoeren. Voor veel van de diensten van Triskal is het niet nodig om persoonsgegevens in te voeren, maar voor enkele diensten stellen we het invoeren van persoonsgegevens als voorwaarde voor het gebruik van de dienst. Daardoor is het mogelijk dat je geen gebruik kunt maken van sommige diensten als je ervoor kiest geen persoonsgegevens aan Triskal te verstrekken. Je kunt zonder volledige registratie niet deelnemen aan de prijsvragen op de site.

Het verzamelen van persoonsgegevens

Triskal verwerkt persoonsgegevens die worden verstrekt door haar bezoekers. Het gaat hierbij om gegevens als naam, adres, woonplaats, geboortedatum, sekse en e-mailadres, maar ook om gegevens over interesses van jou als gebruiker van één van onze websites. Je hebt ons deze gegevens verstrekt doordat je bij één van onze diensten hebt aangegeven dat bepaalde onderwerpen je interesseren. Het is ook mogelijk dat Triskal de interessegebieden zelf afleidt uit het surfgedrag van haar bezoekers (bijvoorbeeld door te kijken welke webpagina’s zijn bezocht).

Omgaan met persoonsgegevens

Het spreekt voor zich dat Triskal zeer zorgvuldig omgaat met jouw persoonsgegevens. Triskal verwerkt je gegevens in de eerste plaats om diensten, producten en/of informatie aan te bieden die passen bij de interesses van de beoogde gebruikers. Bovendien kunnen we deze kennis gebruiken om bestaande diensten van Triskal aan te passen aan de behoeften en wensen van de bezoekers van onze websites. Als het gaat om een betaalde dienst gebruikt Triskal de gegevens eveneens om te factureren. Het is ook mogelijk dat Triskal de gegevens gebruikt om gericht (commerciële) aanbiedingen te doen of haar gebruikers te informeren over nieuwe diensten van Triskal. Aan derden

Triskal werkt uitsluitend samen met een erkende e-mail marketingorganisatie: Mail Chimp, die aangesloten is bij de DDMA. Deze erkende e-mail marketingorganisatie biedt u een dienst die u met name van alle voordelen gebruik laat maken en die helemaal op u gericht is. Wilt u de Mail Media mailings niet meer ontvangen? U kunt zich uitschrijven van deze mails van derden door in de betreffende nieuwsbrief af te melden voor dit type mail.

Het is mogelijk dat Triskal op grond van een wettelijke plicht gegevens moet verstrekken, bijvoorbeeld aan de politie in het kader van een opsporingsonderzoek. Triskal zal persoonsgegevens in deze gevallen uitsluitend verstrekken als duidelijk is dat het gaat om een gerechtvaardigd verzoek van de instantie aan wie de gegevens moeten worden verstrekt. Triskal kan besluiten bepaalde gegevens te bewaren indien dit noodzakelijk is om de rechten van gebruikers van de Triskal-diensten of om de rechten van Triskal te beschermen.

Beheer

Triskal is van mening dat haar systemen altijd goed moeten functioneren en over voldoende capaciteit moeten beschikken. Om die reden maakt Triskal back-ups van bijvoorbeeld de mailsystemen. De back-ups gebruikt Triskal uitsluitend om systemen weer in de oude staat te herstellen als een storing is opgetreden. Triskal analyseert het gebruik van haar systemen om te bepalen welke capaciteit nodig is en om te controleren of de systemen goed functioneren.

User Content

Triskal staat het posten van content door gebruikers in blogs, Facebook en Instagram, forum et cetera toe, inclusief het publiceren van foto’s, commentaar en diversen. Alles wat door de gebruiker wordt gepubliceerd, wordt gezien als “user content”. De gebruiker behoudt hierdoor alle rechten op en is zelf verantwoordelijk voor de inhoud die geplaatst wordt op deze media.

Beveiliging

Het kraken van websites is regelmatig in het nieuws. Bij een geslaagde kraak kunnen gegevens over gebruikers van de websites op straat komen te liggen. Triskal wil vanzelfsprekend voorkomen dat haar websites worden gekraakt. Om die reden legt Triskal vast vanaf welke computers gebruik wordt gemaakt van de Triskal-diensten. Ook wordt continu gekeken of iemand niet illegaal probeert zich toegang te verschaffen tot de Triskal computers. De gegevens die worden vastgelegd, worden niet langer bewaard dan nodig voor een goede beveiliging.

Uw rechten

Triskal wil duidelijk zijn over de manier waarop ze met uw persoonsgegevens omgaat. Deze privacyverklaring wil daar een bijdrage aan leveren. Als u echter vragen heeft over de manier waarop Triskal met uw persoonsgegevens omgaat, kunt u altijd een bericht sturen aan: paul[at]Triskal.org. U kunt ook een bericht aan bovenstaand adres sturen als u wilt weten welke gegevens over u zijn vastgelegd, als u gegevens wilt corrigeren en als u gegevens wilt laten wissen. Ook kunt u doorgeven dat u niet langer prijs stelt op het per e-mail of post ontvangen van aanbiedingen. GENERAL

1 – QUOTATIONS

All offers, where the contrary is not explicitly stated, count as a non-binding offer that can also be revoked after acceptance. If this revocation does not take place within 6 working days after the acceptance, the agreement has been concluded.

2 – FORMATION OF THE AGREEMENT

2.1 The Agreement is formed by these general terms and conditions together with the order confirmation and is concluded when the order confirmation has been received digitally by the Contractor and / or the order confirmation signed by the Contractor and the Client has been returned by the Contractor. As long as the order confirmation has not been returned, the Contractor reserves the right to deploy its (personnel) capacity elsewhere. The order confirmation is based on the information provided by the Client to the Contractor at the time. The order confirmation is deemed to represent the Agreement correctly and completely.

2.2 The Agreement supersedes and replaces all previous proposals, correspondence, agreements or other communications, whether made in writing or orally.

2.3 The Agreement is entered into for an indefinite period of time, unless it follows from the content, nature or purport of the granted Assignment that it has been entered into for a definite period of time.

2.4 Every agreement concluded between the Client and the Contractor is fully binding for both parties, unless the Contractor informs the Client within 12 days after the agreement has been concluded, stating reasons, that he dissolves the agreement.

3 – COOPERATION BY THE CLIENT

3.1 The Client must ensure that all information and documents that the Contractor needs in accordance with its judgment for the correct and timely execution of the granted Assignment are made available to the Contractor in a timely manner and in the form and manner desired by the Contractor.

3.2 The Client must ensure that the Contractor is immediately informed of facts and circumstances that may be important in connection with the correct execution of the assignment.

3.3 Unless the nature of the Assignment dictates otherwise, the Client is responsible for the correctness, completeness and reliability of the data and documents made available to the Contractor, even if these come from or from third parties.

3.4 The Client must ensure that the Contractor is provided with office space and other facilities that, in the opinion of the Contractor, are necessary or useful to execute the agreement and that meet all (legal) requirements. This includes the use of computer, telephone and fax facilities. With regard to (computer) facilities made available, the Client is obliged to take care of continuity, including through adequate backup, security and virus control procedures.

3.5 Unless the nature of the Assignment dictates otherwise, the Client will deploy the staff deemed necessary by the Contractor or have them deployed in order to enable the Contractor to perform the work. If specific personnel is required, this will be agreed and recorded in the order confirmation. The Client must ensure that its personnel has the right skills and experience to perform the work.

3.6 The extra costs and extra fees arising from the delay in the execution of the Assignment, arising from the failure to provide the requested information, documents, facilities and / or personnel, or to make them in time or properly, will be for the Client’s account.

4 – PERFORMANCE OF THE CONTRACT

4.1 All activities performed by the Contractor are carried out to the best of his knowledge and ability in accordance with the requirements of good workmanship. With regard to the intended work, there is a best effort obligation on the part of the Contractor, unless explicitly stated otherwise.

4.2 The Contractor will determine the manner in which and by which employee (s) the Assignment will be carried out, but will observe the requirements made known by the Client as much as possible. If (an) employee (s) is mentioned by name in the order confirmation / engagement letter, the Contractor will endeavor to ensure that the employee (s) concerned remain available (or remain available) throughout the term of the Assignment. ) for carrying out the work. Notwithstanding the foregoing, the Contractor has the right to replace such employees after consultation with the Client.

4.3 The Contractor may first carry out more work and charge the Client than for which the Assignment has been issued, if the Client has given prior permission for this. However, if the Contractor is obliged to perform additional work by virtue of its (statutory) duty of care, it is entitled to charge this to the Client, even if the Client has not explicitly given its prior permission to perform the additional work.

4.4 If the Client wishes to involve third parties in the performance of the Assignment, it will only proceed to do so after having reached an agreement with the Contractor, since involving a third party directly or indirectly in the performance of the Assignment can have a significant impact on the possibilities of the Contractor to execute the Assignment correctly. The provisions of the previous sentence apply mutatis mutandis to the Contractor.

4.5 With regard to the Assignment, the Contractor will keep a work file containing copies of relevant documents, which is the property of the Contractor.

5 – CONFIDENTIALITY

5.1 Unless any statutory provision, regulation or other (professional) rule obliges her to do so, the Contractor / the employee (s) deployed by the Contractor are obliged to maintain confidentiality towards third parties with regard to confidential information obtained from the Client. The Client can grant an exemption in this regard.

5.2 Subject to the Client’s written permission, the Contractor is not entitled to use the confidential information made available to it by the Client for any purpose other than for which it was obtained. However, an exception is made to this in the event that the Contractor acts for itself in civil or criminal proceedings where this information may be important.

5.3 Unless there is any statutory provision, regulation or other rule that the Client is obliged to disclose or that the Contractor has given prior written permission to do so, the Client will not disclose the content of reports, advice or other written or non-written statements by the Contractor to third parties.

5.4 The Contractor and the Client will impose their obligations under this article on third parties to be engaged by them.

5.5 If not considered to be in conflict with the provisions of Articles 5.1 and 5.2, the Contractor is entitled to state in outline the work performed to (potential) customers of the Contractor and only to indicate the experience of the Contractor.

6 – INTELLECTUAL PROPERTY

6.1 The Contractor reserves all intellectual property rights with regard to products of the mind which it uses or has used and / or develops and / or has developed in the context of the execution of the Assignment, and in respect of which it holds the copyrights or has or can assert other intellectual property rights.

6.2 The Client is expressly prohibited from multiplying those products, including computer programs, system designs, working methods, advice, (model) contracts and other mental products of the Contractor, all this in the broadest sense of the word, whether or not with third parties. , to disclose or to exploit. Reproduction and / or publication and / or exploitation is only permitted after obtaining written permission from the Contractor. The Client has the right to multiply the written documents for use within its own organization, insofar as appropriate within the purpose of the Assignment. In the event of premature termination of the Assignment, the foregoing applies mutatis mutandis.

7 – EXERCISE OF THE CONSUMER’S RIGHT OF WITHDRAWAL AND ITS COSTS

7.1 If the consumer makes use of his right of withdrawal, he must report this within the cooling-off period by means of a clear email to paul@triskal.org or in another unambiguous manner to the entrepreneur.

7.2 As soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, the consumer will return the product, or hand it over to (an authorized representative of) the entrepreneur. This is not necessary if the entrepreneur has offered to collect the product himself. The consumer has in any case observed the return period if he returns the product before the cooling-off period has expired.

7.3 The consumer returns the product with all accessories supplied, if reasonably possible in the original condition and packaging, and in accordance with the reasonable and clear instruction provided by the entrepreneur.

7.4 The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.

7.5 The consumer bears the direct costs of returning the product. If the entrepreneur has not reported that the consumer must bear these costs or if the entrepreneur indicates to bear the costs himself, the consumer does not have to bear the costs for return.

7.6 If the consumer makes use of his right of withdrawal, all additional agreements will be terminated by operation of law.

8 – PAYMENT

8.1 Payment by the Client must be made without deduction, discount or setoff within 15 days of the invoice date. Payment must be made in the currency indicated on the invoice, by transfer to a bank account to be designated by the Contractor. Objections to the amount of the invoices submitted do not suspend the Client’s payment obligation.

8.2 If the term referred to under 8.1 is exceeded, the Client will be in default by operation of law after having been notified by the Contractor at least once to pay within a reasonable period. In that case, the Client will owe statutory interest from the date on which the amount due has become due and payable until the time of payment. In addition, all costs of collection, after the Client is in default, both judicial and extrajudicial, will be borne by the Client. If the Contractor has to take collection measures after the due date, the Client will owe extrajudicial costs – in accordance with “Voorwerk II Report”.

8.3 If, in the opinion of the Contractor, the financial position and / or payment behavior of the Client gives cause to do so, the Contractor is entitled to require the Client to provide immediate (additional) security in a form to be determined by the Contractor and / or to provide an advance. . If the Client fails to provide the required security, the Contractor is entitled, without prejudice to his other rights, to immediately suspend the further execution of the Assignment and all that the Client owes the Contractor for whatever reason is immediately due and payable.

8.4 In the event of a jointly given Assignment, the Clients are severally and severally liable for the payment of the full invoice amount insofar as the work has been performed for the joint Clients.

9 – COMPLAINTS

9.1 Complaints with regard to the work performed and / or the invoice amount must be made in writing within 15 working days after the sending date of the documents or information about which the Client complains, or within 15 working days after the discovery of the defect, if the Client demonstrates that he does not reasonably previously discovered, to be made known to the Contractor.

9.2 Complaints as referred to in the first paragraph do not suspend the Client’s payment obligation. Under no circumstances is the Client entitled to postpone or refuse payment of other services provided by the Contractor to which the complaint does not relate on the basis of a complaint relating to a particular service.

9.3 In the event of a justified complaint, the Client has the choice between adjusting the fee charged, improving or redoing the rejected work free of charge, or not or no longer executing the Assignment in whole or in part, in proportion to the amount paid by Client already paid fees.

10 – DELIVERY PERIOD

10.1 If the Client owes an advance payment or if it has to provide information and / or materials necessary for the implementation, the period within which the work must be completed will not start until the payment has been received in full by the Contractor, respectively. and / or materials have been made available to her in full.

10.2 Because the duration of the Assignment can be influenced by all kinds of factors, such as the quality of the information that the Client provides and the cooperation that is provided, the terms within which the activities must be completed can only be regarded as deadlines if this is expressly stated. has been agreed in writing.

10.3 The Agreement can – unless it has been established that execution is permanently impossible – not be dissolved by the Client due to exceeding the term, unless the Contractor also does not or not fully execute the Agreement within a reasonable period of time, which has been notified to it in writing after the agreed delivery period. Dissolution is then permitted in accordance with Article 265 Book 6 of the Civil Code.

11 – TERMINATION

11.1 The Client and the Contractor can terminate the Agreement at any time (prematurely) by registered letter, with due observance of a reasonable notice period, unless reasonableness and fairness oppose termination or termination on such a term.

11.2 The Agreement may be terminated (prematurely) by either party by registered letter without observing a notice period in the event that the other party is unable to pay its debts or if a trustee, administrator or liquidator has been appointed, the other party. is in debt restructuring, or ceases its activities for any other reason or if the other party deems the occurrence of any of the above circumstances to be reasonably plausible in one party or if a situation arises that justifies immediate termination in the interest of the terminating party .

If (interim) cancellation has been made by the Contractor, the Client is entitled to the Contractor’s cooperation in the transfer of work to third parties, unless there are facts and circumstances underlying the cancellation that can be attributed to the Client. In all cases of (interim) cancellation, the Contractor retains the right to payment of the invoices for work performed by it up to that time, whereby the Client will make the provisional results of the work performed up to that date subject to provisional results. Insofar as the transfer of the work involves additional costs for the Contractor, these will be charged to the Client.

11.4 Upon termination of the Agreement, each of the parties must immediately hand over to the other party all goods, objects and documents in its possession that belong to the other party.

12 – LIABILITY

12.1 The Contractor will perform its work to the best of its ability and observe the care that can be expected from the Contractor. If a mistake is made because the Client has provided the Contractor with incorrect or incomplete information, the Contractor is not liable for the resulting damage. If the Client demonstrates that it has suffered damage as a result of an error on the part of the Contractor that would have been avoided with careful action, the Contractor is only liable for direct damage up to a maximum amount of € 1,000.

12.2 Direct damage exclusively means:

– the reasonable costs for determining the cause and the extent of the damage, insofar as the determination relates to damage within the meaning of these conditions;

– any reasonable costs incurred to have the faulty performance of the Contractor comply with the agreement, insofar as these can be attributed to the Contractor;

-reasonable costs incurred to prevent or limit damage, insofar as the Client demonstrates that these costs have led to limitation of direct damage as referred to in these general terms and conditions.

12.3 The Contractor is never liable for indirect damage, including consequential damage, loss of profit, missed savings, damage due to business interruption, costs resulting from sentencing in legal costs, interest and / or delay damage, damage resulting from the provision of insufficient cooperation and / or information. of the Client, and / or damage due to non-binding information or advice given by the Contractor, the content of which does not explicitly form part of the written agreement.

12.4 The Client indemnifies the Contractor against claims from third parties due to damage caused by the fact that the Client has provided the Contractor with incorrect or incomplete information, unless the Client demonstrates that the damage is not related to culpable acts or omissions attributable to it or caused by intent. or equivalent gross negligence on the part of the Contractor and unless any mandatory (inter) national law or regulation does not permit such a provision.

12.5 The limitation of liability laid down in paragraph 1 of this article is also stipulated for the benefit of third parties engaged by the Contractor for the execution of the Assignment.

12.6 The contractor is not liable for damage to or destruction of documents during transport or during dispatch by post, regardless of whether the transport or dispatch is carried out by or on behalf of the client, contractor or third parties.

13 – CONTRACT TAKEOVER

13.1 The Client is not permitted to transfer (any obligation under) the Agreement to third parties, unless the Contractor explicitly agrees to this. The contractor is entitled to attach conditions to this permission. The client undertakes in any case to impose all relevant (payment) obligations under the Agreement in these general terms and conditions on the third party. Client will at all times remain liable in addition to this third party for the obligations under the Agreement and the General Terms and Conditions, unless the parties explicitly agree otherwise.

13.2 In the event of a contract takeover, the Client indemnifies the Contractor against all third-party claims that may arise as a result of the Client’s failure to comply or to comply with any obligation under the Agreement and / or these general terms and conditions, unless any mandatory (inter) national law or regulations do not allow such a provision.

14 – INTERNET USE

During the execution of the Assignment, the Client and the Contractor will be able to communicate with each other at the request of one of them by means of electronic mail. Both the Contractor and the Client recognize that the use of electronic mail involves risks such as – but not limited to – distortion, delay and virus. The Client and the Contractor hereby declare that they will not be liable to each other for any damage that may result from one or each of them as a result of the use of electronic mail. Both the Client and the Contractor will do or not do everything that can reasonably be expected of each of them to prevent the aforementioned risks from occurring. In case of doubt regarding the correctness of the mail received by the Client or the Contractor,

15 – EXPIRY PERIOD

Insofar as not otherwise provided in the Agreement, the Client’s rights to claim and other powers under whatever heading vis-à-vis the Contractor shall lapse in any event after the expiry of one year from the moment when a fact arises that the Client has these rights and / or powers vis-à-vis the Contractor. can use.

16 – AFTER-EFFECT

The provisions of this Agreement, which are expressly or tacitly intended to remain in force even after termination of this Agreement, will remain in effect thereafter and will continue to bind both parties.

17 – APPLICABLE LAW AND CHOICE OF FORUM

17.1 Dutch law applies to all Agreements between the Client and the Contractor.

17.2 The court of the place of residence of the contractor has jurisdiction over all disputes arising from this agreement, unless another court has mandatory jurisdiction under the law.
